TERMS OF SERVICE — PBST - Pokémon TCG BST UK (Discord Bot)

These Terms of Service ("Terms") govern your access to and use of the PBST - Pokémon TCG BST UK Discord bot ("the Bot"). By adding the Bot to a Discord server, or by interacting with the Bot (using its commands, buttons, or features) on any server where it is present, you agree to these Terms. If you do not agree, you should not use the Bot.
1. WHO WE ARE
The Bot is developed and operated by Sam Mosley, an individual based in the United Kingdom.

2. DESCRIPTION OF SERVICE
The Bot provides moderation, role management, engagement, and utility features for Discord servers, including but not limited to:
Moderation tools (warnings, bans, kicks, timeouts, message clearing)
Role management (timed roles, persistent roles, role panels)
A reputation and leveling/XP system
A giveaway system
A support ticket system
Automated content checks (blocked links, profanity filtering, repost detection)
Automated safety features (new-account checks, impersonation detection, user detention)
A news/announcement feed and scheduled messaging
Utility commands (reminders, birthdays, random pick/number, affiliate-link conversion)
A companion web dashboard used by authorised server administrators to configure the Bot
Features may be added, modified, suspended, or removed at any time without prior notice.
The Bot is currently provided free of charge.
3. ELIGIBILITY
You must meet Discord's minimum age requirement to use Discord and, by extension, this Bot. If a server sets a higher minimum age (for example, 18+), that requirement also applies.
You must comply with Discord's Terms of Service, Community Guidelines, Developer Policies (where applicable), and all applicable laws while using the Bot.
4. ACCEPTABLE USE
When using the Bot, you agree not to:
Attempt to exploit, abuse, or circumvent the Bot's moderation, giveaway, reputation or ticket systems.
Create alternate accounts to manipulate giveaways, XP, reputation or other Bot features.
Harass, threaten, abuse or impersonate other users.
Reverse engineer, interfere with or attempt unauthorised access to the Bot, its infrastructure, database or dashboard.
Use the Bot for unlawful purposes.
Submit false, misleading or abusive content through tickets or Bot features.
Spam or excessively abuse Bot commands.
We reserve the right to rate limit excessive usage where necessary to protect the stability, security and availability of the Bot.
We may also suspend or permanently restrict access to the Bot where these Terms or Discord's policies are violated.
5. MODERATION ACTIONS
The Bot performs moderation actions according to rules configured by each individual Discord server.
These actions may include warnings, message deletion, kicks, bans, timeouts and role changes.
Server owners and moderators are solely responsible for how they configure and use these moderation features. We are not responsible for moderation decisions made by individual communities.
Some safety detections (such as impersonation alerts) are intended only to assist moderators and may require manual review before any action is taken.
6. GIVEAWAYS
Giveaways are organised and managed by the server hosting them.
The Bot simply provides the technical functionality for accepting entries and selecting winners according to the configured rules.
Prize fulfilment, eligibility requirements and giveaway disputes remain the responsibility of the hosting server.
7. TICKETS
Support tickets, ticket messages, submitted forms and ticket transcripts may be visible to authorised members of the server's moderation team.
Please do not submit passwords, payment information or other highly sensitive personal information through the ticket system.
8. THIRD-PARTY SERVICES
The Bot may interact with or generate links relating to third-party services including Discord, Amazon, X (formerly Twitter), or other supported platforms.
Use of those services is governed by their own terms and privacy policies.
We are not responsible for the content, availability or operation of third-party services.
9. AVAILABILITY
Although we aim to provide reliable service, we cannot guarantee uninterrupted or error-free availability.
The Bot may become unavailable due to maintenance, updates, hosting issues, API changes or events outside our control.
10. SECURITY
We take reasonable technical and organisational measures to protect information processed by the Bot.
However, no online service can guarantee absolute security, and users acknowledge that they use the Bot at their own risk.
11. DISCLAIMER OF WARRANTIES
The Bot is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose or non-infringement.
12. LIMITATION OF LIABILITY
To the fullest extent permitted by law, we are not liable for indirect, incidental, consequential or special damages arising from use of the Bot.
This includes, but is not limited to:
Loss of data
Loss of XP, reputation or roles
Giveaway disputes
Ticket disputes
Moderation actions
Temporary or permanent downtime
As the Bot is provided free of charge, our total liability shall not exceed any amount actually paid by you for use of the Bot.
13. DATA AND PRIVACY
Your use of the Bot is also governed by our Privacy Policy.

By using the Bot, you also agree to our Privacy Policy.
14. DASHBOARD ACCESS
Where available, the Bot's web dashboard is intended only for authorised server administrators.
Authentication is performed using Discord OAuth, and access is limited according to permissions granted within Discord.
15. INTELLECTUAL PROPERTY
The Bot, its source code, branding, graphics and associated assets remain the intellectual property of their respective owner(s).
You may not copy, distribute, modify, sell or create derivative works without prior written permission.
16. TERMINATION
We may suspend or terminate access to the Bot, remove it from a server or restrict individual users at any time where necessary to enforce these Terms, comply with applicable law or protect the integrity of the Bot.
Server administrators may remove the Bot from their server at any time.
17. CHANGES TO THESE TERMS
We may update these Terms from time to time.
Changes will be reflected by updating the "Last updated" date shown at the top of this document.
Continued use of the Bot after changes become effective constitutes acceptance of the revised Terms.
18. GOVERNING LAW
These Terms are governed by the laws of England and Wales.
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
19. SEVERABILITY
If any provision of these Terms is found to be invalid, illegal or unenforceable, the remaining provisions shall continue in full force and effect.
20. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy, constitute the entire agreement governing your use of the Bot and supersede any previous understandings relating to its use.
