TERMS OF SERVICE — [PBST - Pokemon TCG BST UK] (DISCORD BOT)

These Terms of Service ("Terms") govern your access to and use of the [PBST - Pokemon TCG BST UK] Discord bot ("the Bot"). By adding the Bot to a Discord server, or by interacting with the Bot (using its commands, buttons, or features) on any server where it is present, you agree to these Terms. If you do not agree, do not use the Bot.
1. WHO WE ARE
The Bot is developed and operated by an individual based in the United Kingdom ("we", "us", "our").

2. DESCRIPTION OF SERVICE
The Bot provides moderation, role management, engagement, and utility features for Discord servers, including but not limited to:
- Moderation tools (warnings, bans, kicks, timeouts, message clearing)
- Role management (timed roles, persistent roles, role panels)
- A reputation and leveling/XP system
- A giveaway system
- A support ticket system
- Automated content checks (blocked links, profanity filtering, repost detection)
- Automated safety features (new-account checks, impersonation detection, user detention)
- A news/announcement feed and scheduled messaging
- Utility commands (reminders, birthdays, random pick/number, affiliate-link conversion)
- A companion web dashboard used by server administrators to configure the Bot
Features may be added, changed, or removed at any time without prior notice, at our discretion.
3. ELIGIBILITY
You must meet Discord's own minimum age requirement (as set out in Discord's Terms of Service) to use Discord and, by extension, the Bot. If a server the Bot operates on sets a higher age requirement (e.g. 18+), that requirement also applies to your use of the Bot on that server.
You must also comply with Discord's Terms of Service and Community Guidelines at all times while using the Bot.
4. ACCEPTABLE USE
When using the Bot, you agree not to:
- Attempt to exploit, abuse, or circumvent the Bot's moderation, giveaway, reputation, or ticket systems (e.g. creating alternate accounts to gain unfair advantage, farming reputation, or manipulating giveaway entries)
- Use the Bot to harass, abuse, impersonate, or harm other users
- Attempt to interfere with, disrupt, reverse-engineer, or gain unauthorised access to the Bot, its database, or its dashboard
- Use the Bot for any unlawful purpose or in a way that violates Discord's Terms of Service
- Submit false, misleading, or abusive content through tickets, custom commands, or any other Bot feature
- Attempt to spam or flood the Bot's commands in a way that degrades service for others
We reserve the right to restrict, suspend, or block any user's ability to interact with the Bot, or to remove the Bot entirely from a server, if these Terms or Discord's own rules are violated.
5. MODERATION ACTIONS AND ENFORCEMENT
The Bot carries out moderation and automated actions (such as warnings, bans, kicks, timeouts, role changes, or message removal) based on rules configured by the administrators of the server where the Bot is used. We are not responsible for how individual server administrators or moderators configure or apply these features. Disputes about moderation decisions on a specific server should be raised with that server's own administrators/moderators in the first instance.
Some safety-related detections (e.g. impersonation flags) are routed to human moderators for review rather than resulting in automatic, irreversible action.
6. GIVEAWAYS
Giveaways run through the Bot are administered by the server on which they are hosted, using rules and requirements set by that server's administrators (e.g. required roles, minimum message counts, tags). We do not guarantee eligibility, outcomes, or prize fulfilment for any giveaway — these are the responsibility of the hosting server/administrator. The Bot only provides the technical mechanism for entry and drawing winners fairly based on the configured rules.
7. TICKETS AND SUPPORT REQUESTS
Ticket contents (messages, form answers, and transcripts) are visible to relevant server staff for the purpose of resolving the request and may be retained for a limited period as described in our Privacy Policy. Do not share sensitive personal information (e.g. financial details, passwords) through the ticket system.
8. THIRD-PARTY LINKS AND SERVICES
The Bot may generate or convert links (e.g. Amazon affiliate links) or pull content from third-party sources (e.g. an X/Twitter feed). We are not responsible for the content, accuracy, or availability of any third-party website, service, or link referenced or generated by the Bot. Use of third-party services (Discord, Amazon, X, etc.) is subject to their own terms and policies.
9. AVAILABILITY
We aim to keep the Bot online and available but do not guarantee uninterrupted, error-free, or continuous operation. The Bot may be unavailable due to maintenance, updates, hosting issues, or factors outside our control (including Discord outages or API changes). We are not liable for any loss or inconvenience resulting from downtime.
10. DISCLAIMER OF WARRANTIES
The Bot is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Bot will be error-free, secure, or available at all times.
11. LIMITATION OF LIABILITY
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Bot, including but not limited to loss of data, loss of roles/XP/reputation, moderation actions taken against you, or any dispute arising from a giveaway or ticket. Our total liability for any claim relating to the Bot is limited to the amount (if any) you have paid us for related services, which for the vast majority of users is zero, as the Bot is provided free of charge.
12. DATA AND PRIVACY
Our collection and use of personal data through the Bot is described in our separate Privacy Policy, which forms part of these Terms. By using the Bot, you also agree to the Privacy Policy.
13. INTELLECTUAL PROPERTY
The Bot's code, branding, and associated assets remain the property of their respective owner(s). You may not copy, redistribute, resell, or create derivative works from the Bot without prior written permission.
14. TERMINATION
We may remove the Bot from any server, or restrict a specific user's access to Bot features, at any time and without notice, particularly in cases of abuse, violation of these Terms, or violation of Discord's own policies. Server administrators may also remove the Bot from their own server at any time.
15. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to the Bot's features or legal requirements. Material changes will be reflected with an updated "Last updated" date at the top of this document. Continued use of the Bot after changes constitutes acceptance of the revised Terms.
16. GOVERNING LAW
These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or use of the Bot will be subject to the exclusive jurisdiction of the courts of England and Wales.
